Definition

Cassation (civil procedure, criminal procedure) [Fr.: cassation; Ro.: casare; Gr.: αναίρεση] (See also: appeal, redress, jurisprudence, administration of justice) = partial or total quashing of a judicial decision after a petition for review [Fr.: pourvois en cassation; Ro.: recurs în casaţie; Gr.: αίτηση αναιρέσεως] is made to a higher court in order to verify the compliance of the respective decision with the rule of law. The court does not examine the facts of the case. 

Court of ~ [Ro.: Curte de casaţie; Fr.: Cour de~; Gr.: Ανώτατο Ακυρωτικό Δικαστήριο] = a high court with the power to quash a judicial decision made by a lower court. Generally, courts of cassation do not rule on the constitutionality of the law, differing in this matter from supreme courts such as those of the United States or Japan.
